Short Title:      Allow Restaurants to Use Outdoor Grills.

A BILL TO BE ENTITLED

AN ACT allowing establishments that prepare or serve food for human consumption to use outdoor grills for food preparation.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 130A‑248 is amended by adding a new subsection to read:

"(a7)    Notwithstanding any provision of this Part, a permitted establishment that prepares or serves food may use an outdoor grill to prepare food for customers if all of the following criteria are met:

(1)        The outdoor grill is made of stainless steel and is stationed on a level, concrete foundation.

(2)        The outdoor grill has a semi‑permanent cover to protect it from weather, dust, and animals.

(3)        The outdoor grill, semi‑permanent cover, and concrete foundation are cleaned daily.

(4)        Food prepared on the outdoor grill is processed inside the permitted establishment, in the kitchen or in a room that meets the requirements of sanitation specified for a restaurant kitchen."

SECTION 2.  This act becomes effective October 1, 2017.
