Short Title:        Require Blood Test for All Deaths by Vehicle.

A BILL TO BE ENTITLED

AN ACT to require that law enforcement perform a blood test on any person criminally charged in any case involving death by vehicle.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 20-141.4  is amended by adding a new subsection to read:

"(d)      Chemical Analysis. - A law enforcement officer charging any person with a violation of this section shall conduct a chemical analysis of the person's blood pursuant to G.S. 20-139.1. A violation of this subsection is not grounds for dismissal and is not assignable as error on appeal."

SECTION 2.  This act becomes effective October 1, 2011, and applies to offenses committed on or after that date.
