A BILL TO BE ENTITLED

AN ACT to direct the joint legislative transportation oversight committee to review the laws of this State and other states relating to the use of motorcycle helmets, and to consider whether the state's motor vehicle laws should be amended to provide certain exceptions to the requirement that all operators and passengers on motorcycles or mopeds wear a safety helmeT.

The General Assembly of North Carolina enacts:

SECTION 1.  The Joint Legislative Transportation Oversight Committee shall review the laws of this State and other states relating to the use of motorcycle helmets, and consider whether the State's motor vehicle laws should be amended to provide exceptions to the requirement that all operators and passengers on motorcycles or mopeds wear a safety helmet. The study shall include an analysis of the following:

(1)        Current statutory requirements for mandatory helmet use.

(2)        Studies of the effectiveness of motorcycle helmets and motorcycle helmet laws.

(3)        The effect of motorcycle helmet laws, or the repeal of those laws, on medical costs and insurance premiums.

(4)        Injury prevention, including safety training and driver education.

(5)        Penalties for noncompliance, including the assessment of fines and/or court costs.

(6)        Fiscal implications for State and local governments.

The Joint Legislative Transportation Oversight Committee shall report its findings and recommendations, including any proposed legislation, to the General Assembly on or before the date of the convening of the 2014 Regular Session.

SECTION 2.  This act is effective when it becomes law.
