A BILL TO BE ENTITLED

AN ACT to invalidate any agreement that reduces a national guard member's reemployment rights.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 16 of Chapter 127A of the General Statutes is amended by adding a new section to read:

"§ 127A‑204.  Arbitration agreement unenforceable; no waiver.

No predispute arbitration agreement is valid or enforceable if the agreement requires arbitration of a dispute arising under this Article. This Article supersedes any agreement that reduces, limits, or eliminates in any manner any right or benefit provided by this Article, including the establishment of an additional prerequisite to the exercise of any right or the receipt of any benefit."

SECTION 2.  This act is effective when it becomes law and applies to contracts entered into on or after that date.
