HOUSE BILL 15

AN ACT to convey certain state lands to the town of wrightsville Beach.

The General Assembly of North Carolina enacts:

SECTION 1.  The State of North Carolina shall convey to the Town of Wrightsville Beach, for consideration of one dollar ($1.00), all its rights, titles, and interests in those certain portions of land more particularly described as follows:

(1)        Any area lying east of the property line established in Chapter 246 of the Public Laws of 1939, as amended, and granted to the Town of Wrightsville Beach by such Chapter 246 of the Public Laws of 1939, as amended, except those areas that are owned by the State of North Carolina by virtue of G.S. 146‑6.

(2)        Being a certain parcel or tract of land located in the Town of Wrightsville Beach, New Hanover County, North Carolina, and being bounded on the west by the property line established in Chapter 246 of the Public Laws of 1939, as amended, said property line being further described in that map recorded in Map Book 3, Page 71, New Hanover County Registry, bounded on the north and south by the north and south margins of East Salisbury Street extended, and bounded on the east by a line parallel to and 100 feet east of the aforementioned property line. Said parcel is further described as follows: Beginning at a chiseled "X" in concrete on the northern margin of East Salisbury Street and said street's eastern terminus, said point being North 77 degrees 49 minutes 50 seconds East a distance of 110.33 feet from NCGS monument "Pier RM1" with North Carolina coordinates of North: 171,233.83 and East of 2,365,974.41 (NAD 83); thence with a line being the extension of the northern margin of East Salisbury Street South 59 degrees 24 minutes 27 seconds East 100.00 feet to a point; thence South 30 degrees 36 minutes 47 seconds West 130.00 feet to a point on the southern margin line of East Salisbury Street extended; thence with said margin extended North 59 degrees 24 minutes 27 seconds West 100.00 feet to a point on the eastern terminus of said street; thence with said street terminus and the property line established by Chapter 246 of the Public Laws of 1939, as amended, North 30 degrees 36 minutes 47 seconds East 130.00 feet to a chiseled "X" in concrete, being the point of beginning. Said parcel has an area of 13,000 sq. ft. or 0.298 acres. To the extent that the area described in this subdivision includes lands that might be subject to ownership by the State of North Carolina pursuant to G.S. 146‑6, the conveyance includes any area that the State of North Carolina may own pursuant to G.S. 146‑6, notwithstanding the exception in subdivision (1) of this section.

SECTION 2.  The conveyance pursuant to Section 1 of this act is subject to the conditions set forth in Section 1 of Chapter 246 of the Public Laws of 1939, as amended.

SECTION 3.  The State of North Carolina shall convey the real property described in Section 1 of this act "as is" and "where is" without warranty. The State makes no representations or warranties concerning the title to the property, the boundaries of the property, the uses to which the property may be put, zoning, local ordinances, or any physical, environmental, health, and safety conditions relating to the property. The Town of Wrightsville Beach shall prepare the instrument of conveyance, and all costs associated with the conveyance of the property shall be borne by the Town. The Department of Administration, in consultation with the Town of Wrightsville Beach, may make changes to the property description contained in Section 1 of this act as necessary.

SECTION 4.  The conveyance of the State's rights, titles, and interests in the real property described in Section 1 of this act shall be exempt from the provisions of Article 7 of Chapter 146 of the General Statutes. The conveyance shall comply with the provisions of Article 16 of Chapter 146 of the General Statutes, provided that the provisions of G.S. 146‑74 shall not apply.

SECTION 5.  This act is effective when it becomes law.
