A BILL TO BE ENTITLED

AN ACT directing the division of motor vehicles to study the feasibility and advisability of exempting all non‑plug‑in hybrid motor vehicles from emissions inspections or allowing a waiver for non‑plug‑in hybrid motor vehicles that fail an emissions inspection due to an error that does not impact air quality.

The General Assembly of North Carolina enacts:

SECTION 1.  Study. – The Division of Motor Vehicles, in consultation with the Division of Air Quality of the Department of Environment and Natural Resources, shall study the feasibility and advisability of (i) exempting all non‑plug‑in hybrid motor vehicles from emissions inspections under Article 3A of Chapter 20 of the General Statutes or (ii) amending Article 3A of Chapter 20 of the General Statutes to require the Division of Motor Vehicles to issue a waiver from the emissions inspection requirement for a non‑plug‑in hybrid motor vehicle if the vehicle fails the analysis of data provided by the on‑board diagnostic equipment due to an error that does not impact air quality.

SECTION 2.  Report. – The Division of Motor Vehicles shall report its findings and recommendations, including any legislative proposals, to the Joint Legislative Transportation Oversight Committee no later than February 1, 2016.

SECTION 3.  Effective Date. – This act is effective when it becomes law.
