A BILL TO BE ENTITLED

AN ACT to allow the division of motor vehicles to develop a process whereby persons who are homebound can apply for a special photo identification card by means other than personal appearance and to make other clarifying changes.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 20-37.7 reads as rewritten:

"§ 20-37.7.  Special identification card.

(b)        Application. - To obtain a special identification card from the Division, a person must complete the application form used to obtain a drivers license. The Division shall adopt rules allowing a person who is homebound to apply for or renew a special photo identification card by means other than personal appearance. For purposes of this subsection, a "person who is homebound" means a person who (i) has a severe disability that causes the person to be homebound and (ii) has a physician's letter certifying that the person is homebound.

(c)        Format. - A special identification card shall include a color photograph of the special identification card holder and be similar in size, shape, and design to a drivers license, but shall clearly state that it does not entitle the person to whom it is issued to operate a motor vehicle. A special identification card issued to an applicant must have the same background color that a drivers license issued to the applicant would have.

SECTION 2.  By no later than October 1, 2013, the Division shall report to the Chairs of the Joint Legislative Transportation Oversight Committee on the status of the implementation of a system allowing persons who are homebound to apply for or renew a special photo identification card by means other than personal appearance. The report shall include, at a minimum, the costs, benefits, and feasibility of implementing such a system.

SECTION 3.  Section 2 of this act is effective when it becomes law. The remainder of this act becomes effective July 1, 2014.
