A BILL TO BE ENTITLED

AN ACT to provide that members of the state highway patrol shall be allowed to engage in certain secondary employment.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 4 of Chapter 20 of the General Statutes is amended by adding a new section to read:

"§ 20-187.4.  Secondary employment.

A member of the State Highway Patrol, subject to the approval of his or her commanding officer, shall be allowed to engage in any secondary employment that does not directly or indirectly create a conflict of interest with the Patrol or impair the member's ability to perform all expected duties. Permitted types of secondary employment include providing security at sporting events and providing security for events benefitting elementary and secondary schools and institutions of higher learning. Nothing in this section shall be construed to allow a member to engage in secondary employment that requires the member to testify in court or make arrests. The Secretary of Public Safety shall adopt orders, rules, and regulations that are consistent with the provisions of this section."

SECTION 2.  This act is effective when it becomes law.
