A BILL TO BE ENTITLED

AN ACT authorizing one-time lump sum retention incentive bonuses for members of the state highway patrol for the 2012-2013 fiscal year.

The General Assembly of North Carolina enacts:

SECTION 1.  The Department of Public Safety (Department) shall use up to the sum of one million six hundred seventy-two thousand four hundred thirteen dollars ($1,672,413) of the funds appropriated to the Department for the 2012-13 fiscal year to award non-recurring, one-time lump sum retention incentive compensation bonuses to the members of the State Highway Patrol who have not received annual statutory step increases under G.S. 20-187.3 as the result of the suspension of those increases pursuant to Section 26.1A.(c) of S.L. 2009-451 and Section 29.8(c) of S.L. 2011-145.

SECTION 2.  Retention incentive compensation bonuses awarded under Section 1 of this act to members of the State Highway Patrol shall be paid during the June 2013 pay period. The amount of each compensation bonus awarded shall equal six times the sum that is the salary difference between the amount of a member's actual monthly salary as of January 1, 2013, and the amount that the member's monthly salary would have been on that date had there not been a suspension of the provisions of G.S. 20-187.3.

SECTION 3.  This act is effective when it becomes law and applies to members of the Highway Patrol who (i) would have been eligible to receive step increases under G.S. 20-187.3, but for the provisions of Section 26.1A.(c) of S.L. 2009-451 and Section 29.8(c) of S.L. 2011-145, and (ii) are employed with the State Highway Patrol in good standing on June 1, 2013.
