Short Title:        Uniformity in Application of Falls Lake Rules.

A BILL TO BE ENTITLED

AN ACT to require uniformity in application and enforcement of the Falls Lake rules.

The General Assembly of North Carolina enacts:

SECTION 1.  Notwithstanding any provision of S.L. 2009-486 to the contrary, rules adopted by the Environmental Management Commission pursuant to S.L. 2009-486 to implement nutrient management strategies for the Falls of the Neuse Reservoir watersheds (hereafter, the "Falls Lake Rules") shall be applied and enforced uniformly across all counties in which a portion of the Upper Neuse River Basin (as defined in S.L. 2009-486) is located. Nutrient loading allocations and nutrient management strategies shall be uniform among all members of any nongeographic category of dischargers subject to controls under the Falls Lake Rules.

SECTION 2.  The Environmental Management Commission shall adopt permanent and temporary rules to implement the requirements of this act by May 1, 2014.

SECTION 3.  This act is effective when it becomes law.
