A BILL TO BE ENTITLED

AN ACT to prohibit a county or city from adopting or enforcing any ordinance, rule, regulation, or resolution that regulates the trimming or removal by a city, town, county, or public airport authority of trees on the property of the airport owned or controlled by the city, town, county, or public airport authority.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 23 of Chapter 153A of the General Statutes is amended by adding a new section to read:

"§ 153A-452.1.  Restrictions on airport tree removal prohibited.

Notwithstanding any other provision of law, a county shall not adopt or enforce any ordinance, rule, regulation, or resolution that regulates the trimming or removal by any city, town, county, or public airport authority of a tree on the property of an airport owned or controlled by the city, town, county, or public airport authority."

SECTION 2.  Article 19 of Chapter 160A of the General Statutes is amended by adding a new section to read:

"§ 160A-458.6.  Restrictions on airport tree removal prohibited.

Notwithstanding any other provision of law, a city shall not adopt or enforce any ordinance, rule, regulation, or resolution that regulates the trimming or removal by any city, town, county, or public airport authority of a tree on the property of an airport owned or controlled by the city, town, county, or public airport authority."

SECTION 3.  Article 4 of Chapter 63 of the General Statutes is amended by adding a new section to read:

"§ 63-37.2.  Restrictions on airport tree removal prohibited.

In accordance with G.S. 153A-452.1 and G.S. 160A-458.6, and notwithstanding any other provision of law, an airport owned or controlled by a city, town, county, or public airport authority shall not be subject to any ordinance, rule, regulation, or resolution adopted by a city or county that regulates the trimming or removal of a tree on the property of an airport owned or controlled by the city, town, county, or public airport authority."

SECTION 4.  This act becomes effective July 1, 2013.
