A BILL TO BE ENTITLED

AN ACT to reinstate the 2009 north carolina energy conservation codes for commercial buildings and repeal the portions of the 2012 north carolina energy conservation codes that apply to commercial buildings.

The General Assembly of North Carolina enacts:

SECTION 1.(a)  Consistent with Chapter 150B of the General Statutes and G.S. 143-138, the Building Code Council shall adopt a North Carolina State Building Code Residential Energy Conservation Code applying to residential buildings that is identical to the portions of the 2012 North Carolina State Building Code Energy Conservation Code that apply to residential buildings.

SECTION 1.(b)  Consistent with Chapter 150B of the General Statutes and G.S. 143-138, the Building Code Council shall adopt a North Carolina State Building Code Non-Residential Energy Conservation Code applying to non-residential buildings that is identical to the portions of the 2009 North Carolina State Building Code Energy Conservation Code that apply to non-residential buildings.

SECTION 2.  The Building Code Council shall repeal the 2012 North Carolina State Building Code Energy Conservation Code.

SECTION 3.  No permit shall be denied or revoked, certificate of compliance denied, order to correct violations issued, stop order issued, defect noted, building condemned, order to take corrective action issued, judicial action brought, or any other action be made under Part 4 of Article 18 of Chapter 153A or Part 5 of Article 19 of Chapter 160A of the General Statutes because of a violation of the 2012 North Carolina State Building Code Energy Conservation Code by a non-residential building if it would not also be a violation of the 2009 North Carolina State Building Code Energy Conservation Code.

SECTION 4.  Section 2 of this act is effective when rules adopted in accordance with Section 1 of this act become effective. The remainder of this act is effective when it becomes law except as to judicial actions referred to in Section 3, and as to those actions, this act applies only to judicial actions filed on or after the effective date of this act.
