A BILL TO BE ENTITLED

AN ACT to restore the allocation of lottery funds for school construction.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 18C‑164 reads as rewritten:

"§ 18C‑164.  Transfer of net revenues.

(c)        The General Assembly shall appropriate the remaining net revenue of the Education Lottery Fund annually in the Current Operations Appropriations Act for education‑related purposes, based upon estimates of lottery net revenue to the Education Lottery Fund provided by the Office of State Budget and Management and the Fiscal Research Division of the Legislative Services Commission.

For the 2014‑2015 fiscal year, the General Assembly shall appropriate twenty‑seven percent (27%) of these funds to the Public School Building Capital Fund. For the 2015‑2016 fiscal year, the General Assembly shall appropriate thirty‑three percent (33%) of these funds to the Public School Building Capital Fund. For the 2016‑2017 fiscal year and subsequent fiscal years, the General Assembly shall appropriate a sum equal to forty percent (40%) of these funds to the Public School Building Capital Fund in accordance with G.S. 115C‑546.2.

(d)        Repealed by Session Laws 2013‑360, s. 6.11(c), effective June 30, 2013.

(e)        If the actual net revenues are less than the appropriation for that given year, then the Governor may transfer from the Education Lottery Reserve Fund an amount sufficient to equal the appropriation by the General Assembly.

(f)         Actual The actual net revenues in excess of the amounts appropriated in a fiscal year shall remain in the Education Lottery Fund.be transferred to the Public School Building Capital Fund and spent in accordance with G.S. 115C‑546.2."

SECTION 2.  G.S. 115C‑546.2(d) reads as rewritten:

"(d)      If funds are Funds appropriated from the Education Lottery Fund to the Public School Building Capital Fund, such funds Fund shall be allocated for school capital construction projects on a per average daily membership basis according to the average daily membership for the budget year as determined and certified by the State Board of Education.

(1),       (2) Repealed by Session Laws 2013‑360, s. 6.11(b), effective July 1, 2013.

(3)        No county shall have to provide matching funds required under subsection (c) of this section.

(4)        A county may use monies in this Fund to pay for school construction projects in local school administrative units and to retire indebtedness incurred for school construction projects.

(5)        A county may not use monies in this Fund to pay for school technology needs."

SECTION 3.  This act becomes effective July 1, 2014.
