A BILL TO BE ENTITLED

AN ACT to modify drivers license fees for shortened duration licenses and persons who retake the road test, to authorize the Division of Motor Vehicles to issue a special plate for members of the Haliwa-Saponi Tribe, And to require the timely completion of the U.S. 401 project from Wake County Into Franklin county.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 20-7(f)(3) reads as rewritten:

"(3)      Duration of license for certain other drivers. - The durations listed in subdivisions (1), (2) and (2a) of this subsection are valid unless the Division determines that a license of shorter duration should be issued when the applicant holds valid documentation issued by, or under the authority of, the United States government that demonstrates the applicant's legal presence of limited duration in the United States. The Division of Motor Vehicles shall charge a fee, to be established by the Division, to verify the provided documentation. In no event shall a license of limited duration expire later than the expiration of the authorization for the applicant's legal presence in the United States. The fee for a drivers license of limited duration under this subdivision shall be the same as for a license issued or renewed under subdivision (1), (2), or (2a) of this subsection."

SECTION 2.  G.S. 20-7 is amended by adding a new subsection to read as follows:

"(i2)      Retaking Road Test. - An applicant for a license under this section who fails a road test shall pay an additional fee, to be determined by the Division of Motor Vehicles, upon retaking the road test. This subsection also applies to applicants seeking a permit or license under G.S. 20-11."

SECTION 3.  G.S. 20-79.4(b) is amended by adding a new subdivision to read as follows:

"§ 20-79.4.  Special registration plates.

(b)        Types. - The Division shall issue the following types of special registration plates:

()          Haliwa-Saponi Tribe. - Issuable to a member of the Haliwa-Saponi Tribe of North Carolina. The plate shall bear the seal of the Haliwa-Saponi Tribe. The Division may not issue the plate authorized by this subdivision unless it receives at least 300 applications for the plate.

SECTION 4.  Article 7 of Chapter 136 is amended by adding a new section to read as follows:

"§ 136-102.10.  Completion schedule for U.S. 401 project into Franklin County.

(a)        The Department of Transportation shall complete the U.S. 401 project north of Jonesville Road in Wake County and into Franklin County according to the following schedule:

(1)        The bypass of Rolesville from Jonesville Road to NC 96, also known as the "B" section, shall be completed no later than the end of 2015.

(2)        The portion of the project known as the "C" section, which involves design, right-of-way acquisition, mitigation, and construction, shall be completed no later than the end of 2019.

(b)        If the project in subsection (a) of this section falls behind schedule such that the project completion dates required by subsection (a) of this section might not be met, then the Department of Transportation shall notify the General Assembly and request an extension to the project schedule provided in subsection (a) of this section."

SECTION 5.  This act becomes effective July 1, 2012.
