A BILL TO BE ENTITLED

AN ACT to permit advertising on school buses.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 115C-47 is amended by adding a new subdivision to read:

"§ 115C-47.  Powers and duties generally.

In addition to the powers and duties designated in G.S. 115C-36, local boards of education shall have the power or duty:

(60)      To sell advertising on school buses. - A local board of education may enter into a contract for the sale of advertising space on the exterior sides of school buses subject to the following limitations:

a.         Advertisements for tobacco products, alcohol products, or political advocacy and advertisements with religious content shall be prohibited.

b.         The advertisements shall not interfere with the effectiveness of any required reflective materials or warning equipment or otherwise impair the safety of students.

c.         Advertisements shall be subject to prior approval by the local board of education.

The superintendent of the local school administrative unit shall use the proceeds of the sale of advertising on school buses to pay bonuses to exemplary teachers as an incentive to keep them in the classroom."

SECTION 2.  This act is effective when it becomes law and applies beginning with the 2011-2012 school year.
