Short Title:        Require "Clean Scan" Prevention Software.

A BILL TO BE ENTITLED

AN ACT to require the division of motor vehicles to establish and implement a software program update for emission inspection computerized programs that will prevent "Clean Scan" reports being erroneously sent to the division.

The General Assembly of North Carolina enacts:

SECTION 1.  The Division of Motor Vehicles shall develop, acquire, or implement a software program update for the emission inspection program annual update that will safeguard against erroneous reporting of "clean scan" data to the Division through electronic means to promote a system that will be automated to the highest degree commercially available and to minimize the potential for intentional fraud, human error, or both.

The Division shall report to the Joint Legislative Transportation Oversight Committee on the progress of implementing the software update not later than October 1, 2011.

SECTION 2.  This act is effective when it becomes law.
