A BILL TO BE ENTITLED

AN ACT to provide that the state's regulation of greenhouse gas emissions shall be no more stringent than any federal regulation and no more stringent than any Federal law.

The General Assembly of North Carolina enacts:

SECTION 1.  No State agency, regulatory board, or commission shall develop, adopt, implement, or enforce any new rule, and no State agency, regulatory board, or commission shall amend, implement, or enforce any existing rule that regulates greenhouse gas emissions or that limits human activity for the purpose of reducing greenhouse gas emissions when the rule is more stringent than any regulation promulgated by a federal agency or more stringent than any federal law.

SECTION 2.  As used in this act, the following definitions apply:

(1)        Greenhouse gas. - Carbon dioxide, methane, nitrous oxide, and fluorinated gases, including chlorofluorocarbons, perfluorocarbons, and sulfur hexafluoride.

(2)        Human activity. - Energy generation by a public utility subject to Chapter 62 of the General Statutes, industrial processes, transportation, agricultural production, waste treatment and disposal, fossil fuel retrieval activities, and any other residential, commercial, or other activities involving the burning of fossil fuels.

SECTION 3.  This act is effective when it becomes law.
