A BILL TO BE ENTITLED

AN ACT to require the governor to cut spending for the current fiscal year.

The General Assembly of North Carolina enacts:

SECTION 1.(a)  Except as provided in subsection (b) of this section and notwithstanding the State Budget Act or any other provision of law, the Director of the Budget shall increase General Fund availability for the 2011-2012 fiscal year by the sum of five hundred thirty-seven million seven hundred forty thousand seven hundred ninety-nine dollars ($537,740,799) by:

(1)        Taking all actions necessary to reduce General Fund expenditures for the remainder of the 2010-2011 fiscal year. This grant of authority includes all powers to balance the budget granted the Governor under Article III, Section 5 of the North Carolina Constitution.

(2)        Identifying funds in non-General Fund accounts for transfer to the General Fund on June 30, 2011.

SECTION 1.(b)  This section does not apply to funds available to the Judicial Branch or the Legislative Branch.

SECTION 2.  This act is effective when it becomes law and applies to the 2010-2011 fiscal year only.
