A BILL TO BE ENTITLED

AN ACT to increase criminal court costs in district and superior court to provide additional funding for the crime victims compensation fund.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 7A-304(a) is amended by adding a new subdivision to read:

"(3c)     For support of the Crime Victims Compensation Fund, the sum of ten dollars ($10.00) in all cases, including cases before a magistrate, to be credited to the Crime Victims Compensation Fund established in G.S. 15B-23."

SECTION 2.  This act becomes effective August 1, 2011, and applies to costs assessed or collected on or after this date. However, in misdemeanor cases or infractions disposed of on or after the effective date by written appearance, waiver of trial or hearing, or plea of guilt or admission of responsibility pursuant to G.S. 7A-180(4) or G.S. 7A-273(2), and within the time limit imposed by G.S. 7A-304(a)(6), in which the citation or other criminal process was issued before the effective date, the costs or fees shall be the lesser of those specified in this section as amended or those specified in the notice portion of the defendant's or respondent's copy of the citation or other criminal process, if any costs or fees are specified in that notice.
