A BILL TO BE ENTITLED

AN ACT to impose a fee for the voluntary dismissal of a domestic violence protective order.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 7A-305 is amended by adding a new subsection to read:

"(a5)     In every action filed in district court pursuant to Chapter 50B of the General Statutes by a person who subsequently seeks and is granted a voluntary dismissal of the action, a cost of one hundred dollars ($100.00) shall be assessed against the person. Costs under this subsection may be waived if the court makes a written finding of good cause shown to grant such a waiver. Costs collected by the clerk pursuant to this subsection shall be remitted to the State Treasurer, who shall deposit the funds in the Domestic Violence Center Fund established under G.S. 50B-9."

SECTION 2.  This act becomes effective July 1, 2011, and applies to costs assessed or collected on or after that date.
