A BILL TO BE ENTITLED

AN ACT to require a supermajority for legislation restricting access to public records and open meetings.

The General Assembly of North Carolina enacts:

SECTION 1.  Chapter 132 of the General Statutes is amended by adding a new section to read:

"§ 132-11.  Procedure for adopting exemptions.

The General Assembly shall not enact a law exempting a document from the provisions of this Chapter except upon a three-fifths vote of the members present and voting of each house."

SECTION 2. Article 33C of Chapter 143 of the General Statutes is amended by adding a new section to read:

"§ 143-318.19.  Procedure for adopting exemptions.

The General Assembly shall not enact a law exempting a public body from the provisions of this Article except upon a three-fifths vote of the members present and voting of each house."

SECTION 3.  This act becomes effective October 1, 2011, and applies to legislation enacted on or after that date.
