A BILL TO BE ENTITLED

AN ACT to permit introduction of evidence regarding Defendants' insurance coverage for liability in any civil action.

The General Assembly of North Carolina enacts:

SECTION 1.  Chapter 8 of the General Statutes is amended by adding a new Article to read:

"Article 16.

"Insurance Coverage.

"§ 8-115.  Evidence of insurance coverage admissible.

Notwithstanding G.S. 8C-1, Rule 411, in any civil proceeding, including the questioning of jurors under G.S. 9-15, counsel of record for the plaintiffs may present evidence or inquire regarding the existence, contents, and coverage of any liability insurance policies held by any defendant."

SECTION 2.  This act becomes effective October 1, 2011, and applies to any cause of action arising on or after that date.
