A BILL TO BE ENTITLED

AN ACT to allow sick leave transfers for state employees subject to the state personnel act and for public school employees.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 2 of Chapter 126 of the General Statutes is amended by adding a new section to read:

"§ 126-8.6.  Sick leave transfers.

The State Personnel Commission shall adopt rules and policies to allow an employee subject to the State Personnel Act to transfer up to 30 days of sick leave per year to other State employees subject to the Act, which may only be used for extended illness and may not be used for retirement credit purposes."

SECTION 2.  Article 2 of Chapter 115C of the General Statutes is amended by adding a new section to read:

"§ 115C-12.3.  Sick leave transfers.

The State Board of Education shall adopt rules and policies to allow public school employees to transfer up to 30 days of sick leave per year to other public school employees employed within the same local education agency. The transferred sick leave may only be used for extended illness and may not be used for retirement credit purposes."

SECTION 3.  This act becomes effective January 1, 2010.
