A BILL TO BE ENTITLED
AN ACT clarifying the status of positions in the office of information technology services as exempt or nonexempt under the state personnel act and relating to the selection and appointment of those employees.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 126‑5(c1) is amended by adding a new subdivision to read:
"(29) Deputy Chief Information Officers, General Counsel, and Chief Financial Officer appointed by the State Chief Information Officer."
SECTION 2. G.S. 147‑33.77(a) reads as rewritten:
"(a) The State Chief Information Officer may
appoint a one or more Chief Deputy Information Officer. Officers,
a General Counsel, and a Chief Financial Officer, each of whom is exempt from
the State Personnel Act, except as to Articles 6 and 7 of Chapter 126 of the
General Statutes. The salary of the Chief Deputy Information Officer each
of these exempt employees shall be set by the State Chief Information
Officer. The State Chief Information Officer may appoint all employees, including
legal counsel, select all other employees necessary to carry out the
powers and duties of the office. These employees office, each of whom
shall be subject to the State Personnel Act.Act, except any
employees designated as policy‑making exempt under G.S. 126‑5(c)."
SECTION 3. This act is effective when it becomes law.
