A BILL TO BE ENTITLED

AN ACT to conform state law with federal law regarding disentitlement to purchase, own, possess, or control a firearm after the felony conviction of certain white collar criminal offenses.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 14-415.1 is amended by adding a new subsection to read:

"(d)      This section does not apply and there is no disentitlement under this section if the felony conviction is a violation under the laws of North Carolina, another state, or the United States that pertains to antitrust violations, unfair trade practices, restraints of trade, or other similar offenses relating to the regulation of business practices."

SECTION 2.  This act becomes effective December 1, 2009.  Prosecutions for offenses committed before the effective date of this act are not abated or affected by this act, and the statutes that would be applicable but for this act remain applicable to those prosecutions.
