A BILL TO BE ENTITLED
AN ACT to direct the state controller to establish and maintain a searchable web site of state awards.
The General Assembly of North Carolina enacts:
SECTION 1. Article 9 of Chapter 143B of the General Statutes is amended by adding a new Part to read:
"Part 30. State Funding and Accountability Transparency Act of 2007.
"§ 143B‑426.45. Definitions. – The following definitions apply in this Part.
(1) Entity. – The term includes all of the following, whether for profit or nonprofit, but does not include an individual who is the recipient of State or federal assistance payments or a State employee who is the recipient of State salary or wages:
a. Corporation.
b. Association.
c. Partnership.
d. Limited liability company.
e. Limited liability partnership.
f. Sole proprietorship.
g. Other legal business entity.
h. Other grantee, contractor, subcontractor, or subgrantee that is not excluded by this subdivision.
i. Political subdivision.
(2) Searchable Web site. – A Web site that allows the public to do all of the following:
a. Search and aggregate State funding by any element required by G.S. 143B‑426.46.
b. Ascertain through a single search the total amount of State funding awarded to an entity by a State award described in sub‑subdivision (3)a. of this section.
c. Ascertain through a single search the total amount of State funding awarded to an entity by a State award described in sub‑subdivision (3)b. of this section.
d. Download data included in sub‑subdivision (2)a. of this subdivision that result from a search.
(3) State award. – All State financial assistance and expenditures over the amount of twenty‑five thousand dollars ($25,000). The term includes all of the following, but does not include funds transferred from one agency to another:
a. Grants, subgrants, loans, awards, cooperative agreements, and other forms of financial assistance.
b. Contracts, subcontracts, purchase orders, and other payments.
"§ 143B‑426.46. Controller to establish and maintain searchable Web site of State awards.
(a) No later than January 1, 2008, the State Controller shall develop and operate a single, searchable Web site, accessible by the public at no cost to access, that includes all of the following information for each State award:
(1) The name of the entity receiving the award and, if applicable, the parent entity of the recipient.
(2) The amount of the award.
(3) The transaction type.
(4) The name of the agency making the award.
(5) The budget program fund source.
(6) A descriptive purpose of each funding action or State award.
(7) The location of the entity receiving the award and the primary location of performance under the award.
(8) Any other relevant information specified by the State Controller.
(b) The single Web site established pursuant to subsection (a) of this section shall allow the user to do all of the following:
(1) Search data for the fiscal year 2007-2008 and each fiscal year thereafter.
(2) Search electronically by field in a single search.
(3) Provide input regarding the utility of the site and recommendations for improvement.
(c) The State Controller may do all of the following:
(1) Designate one or more State agencies to participate in the development, operation, or support of the single Web site and may specify the scope of responsibilities of each agency.
(2) Determine the best and most appropriate data source for development and operation of the single Web site.
(d) State agencies shall comply with the provisions of subsection (e) of this section and shall provide appropriate assistance to the State Controller to ensure the existence and operation of the single Web site.
(e) Nothing in this Part shall require the disclosure of information that is considered confidential by State or federal law."
SECTION 2. This act is effective when it becomes law.
