A JOINT RESOLUTION requesting the legislative research commission study the issue of reducing the waiting period before which cities may order dwellings determined unfit for human habitation to be repaired or demolished.
Whereas, G.S. 160A‑443 allows cities to order a dwelling to be repaired or vacated and closed, if the owner has vacated and closed such dwelling and kept such dwelling vacated and closed for a period of one year; and
Whereas, S.L. 2004‑98 has reduced the waiting period for Winston‑Salem and Reidsville to six months; and
Whereas, other municipalities are interested in a shorter waiting period; and
Whereas, vacant dilapidated buildings become a blight to the community, but that interest must be balanced with property rights and family interests; Now, therefore,
Be it resolved by the Senate, the House of Representatives concurring:
SECTION 1. The Legislative Research Commission is requested to study the issue of whether the waiting period in G.S. 160‑443(5a) and (5b) should be reduced from one year to six months.
SECTION 2. The study requested by this act shall be reported to the 2005 Regular Session of the General Assembly when it reconvenes in 2006.
SECTION 3. This resolution is effective upon ratification.
