A BILL TO BE ENTITLED

AN ACT to clarify regulation of plants.

The General Assembly of North Carolina enacts:

SECTION 1.  Chapter 106 of the General Statutes is amended by adding a new Article to read:

"Article 36B.

"Regulation of Plants.

"§ 106-423.10.  Regulation of plants.

The Board of Agriculture shall have sole authority for the banning of plants as defined in G.S. 106-202.12(7)."

SECTION 2.  This act is effective when it becomes law.
