AN ACT to provide membership guidelines for the Macon-Jackson regional Airport Authority and to provide for the filling of VACANCIES in the airport authority.
The General Assembly of North Carolina enacts:
SECTION 1. Section 2 of S.L. 1997-22, as amended by S.L. 2005-219, reads as rewritten:
"SECTION 2. The Airport Authority shall consist
of five members, who four of whom shall be residents of Jackson
County and one which may be appointed from an adjoining North Carolina
county. who The members shall be appointed to staggered terms
of six years by the Jackson County Board of Commissioners. Members may succeed
themselves in office and serve more than one term. Two initial appointments to
the Airport Authority shall be for two years, two initial appointments to the
Airport Authority shall be for four years, and the remaining two initial
appointments to the Airport Authority shall be for six years. When vacancies occur
in the membership of the Airport Authority, for any reason, the remaining
members of the Airport Authority shall submit a list of two or more candidates
to the Jackson County Board of Commissioners who shall select one from that
list to fill the unexpired term of the vacant office. Each member shall take
and subscribe before the Clerk of Superior Court of Jackson County an oath of
office and file the same with the Jackson County Board of Commissioners.
Membership on the Jackson County Board of Commissioners and the Airport
Authority shall not constitute double office holding within the meaning of
Article VI, Section 9 of the Constitution of North Carolina."
SECTION 2. Effective January 1, 2007, the Jackson County Board of Commissioners shall fill any vacancy that occurs in the membership of the Airport Authority for any reason, to include the expiration of a term of office. The Airport Authority may make recommendations to the Board of Commissioners for consideration when filling a vacancy.
Any individual selected to fill a vacancy shall take and subscribe before the Clerk of Superior Court of Jackson County an oath of office and file the same with the Jackson County Board of Commissioners. Membership on the Jackson County Board of Commissioners and the Airport Authority shall not constitute double office holding within the meaning of Article VI, Section 9 of the Constitution of North Carolina.
SECTION 3. This act is effective when it becomes law.
