HOUSE BILL 755

 

 

AN ACT authorizing the Towns of cary and Garner to acquire property for the present or future location or relocation of telephone, telegraph, electric, or other lines to be operated by public utilities.

 

The General Assembly of North Carolina enacts:

 

SECTION 1.  When acquiring rights-of-way for the construction or improvement of streets, the Town may also locate and acquire such additional rights-of-way as may be necessary for the present or future location or relocation, above or below ground, of telephone, telegraph, electric, and other lines, as well as gas, water, sewerage, oil, and other pipelines to be operated by public utilities defined and regulated under Chapter 62 of the General Statutes. In acquiring real property by eminent domain for these purposes, the Town may use the procedures of either Chapter 40A or Chapter 136 of the General Statutes.

SECTION 2.  This act applies to the Towns of Cary and Garner.

SECTION 3.  This act is effective when it becomes law.
