SENATE BILL 1075

 

 

AN ACT REGARDING FUNDING AND TRANSPORTATION FOR CHILDREN WITH SPECIAL NEEDS.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Notwithstanding any policy or rule adopted by the State Board of Education, if a local school administrative unit provides services to a student pursuant to a current individual education plan from another state while a determination is being made regarding the student's eligibility for services as a child with special needs in North Carolina, the local school administrative unit is entitled to receive State funding to serve the student while the determination is being made.  If the student is later determined not to qualify for services in North Carolina, the local school administrative unit shall not be required to repay State funds received while the determination is being made.

Section 2.  The State Board of Education shall study the issue of school transportation for children with special needs. In the course of the study, the State Board shall consider the difficulty local school administrative units are having in meeting the length of school day requirements for these children.  The State Board shall report the results of the study and its recommendations to the Joint Legislative Education Oversight Committee prior to January 1, 2000.

Section 3.  This act is effective when it becomes law.
