HOUSE BILL 115

 

AN ACT TO MAKE NOTE TAKING BY JURORS A DISCRETIONARY DECISION OF THE PRESIDING JUDGE.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 15A-1228 reads as rewritten:

"§ 15A-1228.  Notes by the jury.

Jurors Except where the judge, on the judge's own motion or the motion of any party, directs otherwise, jurors may make notes and take them into the jury room during their deliberations.  Upon objection of any party, the judge, must instruct the jurors that notes may not be taken."

Sec. 2.  This act becomes effective October 1, 1993, and applies to trials begun on or after that date.

In the General Assembly read three times and ratified this the 23rd day of July, 1993.
