CHAPTER 592

HOUSE BILL 1160

 

AN ACT REGARDING REAL PROPERTY TO BE PURCHASED OR RENTED THAT WAS PREVIOUSLY OCCUPIED BY A PERSON WHO DIED OR HAD A SERIOUS ILLNESS.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Chapter 39 of the General Statutes is amended by adding a new Article to read:

"ARTICLE 9.

"Disclosure.

"§ 39-50.  Death or illness of previous occupant.

In offering real property for sale it shall not be deemed a material fact that the real property was occupied previously by a person who died or had a serious illness while occupying the property; provided, however, that no seller may knowingly make a false statement regarding such past occupancy."

Sec. 2.  Article 1 of Chapter 42 of the General Statutes is amended by adding a new section to read:

"§ 42-14.2.  Death or illness of previous occupant.

In offering real property for rent or lease it shall not be deemed a material fact that the real property was occupied previously by a person who died or had a serious illness while occupying the property; provided, however, that no landlord or lessor may knowingly make a false statement regarding such past occupancy."

Sec. 3.  This act shall become effective July 1, 1989, and shall apply to acts or omissions occurring on or after that date.

In the General Assembly read three times and ratified this the 6th day of July, 1989.
