AN ACT TO AUTHORIZE THE DOT TO EXCHANGE UNECONOMIC REMNANTS CREATED BY HIGHWAY CONSTRUCTION.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Chapter 136 of the General Statutes is amended by adding a new section to read:

"§ 136-44.15.  Uneconomic land remnant exchange.-For the purpose of lessening the adverse impact to tracts of land divided by the construction of a highway project on right-of-way donated by the abutting property owner, the Department of Transportation is authorized to acquire in fee simple the remnants of such divided tracts which cannot feasibly be used with the principal tract of land, for the purpose of exchange with other such property owners.  The sole consideration for the acquisition of any remnant acquired pursuant to this act shall be the exchange of another remnant acquired for the same purpose without additional monetary consideration."

Sec. 2.  This act is effective upon ratification and shall expire June 30, 1988.

In the General Assembly read three times and ratified this the 9th day of June, 1987.
