GENERAL ASSEMBLY OF NORTH CAROLINA

CHAPTER 341
AN ACT TO CLARIFY THAT CONDOMINIUMS IN THE TOWN OF ATLANTIC BEACH SHALL BE CONSIDERED TO BE TRACTS OF FIVE ACRES OR LESS FOR THE PURPOSE OF THE ANNEXATION LAW.
The General Assembly of North Carolina enacts:
Section 1. G.S. 160A-41 is amended by adding a new subdivision to read:
"(3) A condominium unit as defined in Chapter 47A of the General Statutes shall be considered a 'lot or tract five acres or less in size' for purposes of determining the character of an area to be annexed as provided in G.S. 160A-36(c)."
Sec. 2. This act applies to the Town of Atlantic Beach only.
Sec. 3. This act is effective upon ratification but does not affect pending litigation.
