HOUSE BILL 605

 

AN ACT TO AUTHORIZE THE COUNTY OF WAKE TO REGULATE THE PARKING OF MOTOR VEHICLES IN PROPERLY DESIGNATED FIRE LANES ON EITHER PUBLIC OR PRIVATE PROPERTY.  

 

The General Assembly of North Carolina enacts:

 

Section 1. G.S. 153A-139 is amended as follows:

(1)       By designating its present wording as subsection (a).

(2)       By adding a new subsection (b) as follows:

"The governing body of a county may, by ordinance, regulate the stopping, standing or parking of a vehicle in a properly designated fire lane whether on public or private property. Any such ordinance may provide for removal of vehicles parked in violation of the ordinance and the owner of a vehicle parked in violation of an ordinance adopted pursuant to this subsection shall be deemed to have appointed any appropriate law enforcement officer as his agent for the purpose of arranging for the transportation and safe storage of such vehicle."

Sec. 2. This act shall apply only to the county of Wake.

Sec. 3. This act is effective upon ratification.
