HOUSE BILL 511

AN ACT TO AMEND G.S. 153A-159.

The General Assembly of North Carolina enacts:

Section 1.  G.S. 153A-159, entitled "Power of eminent domain conferred", is hereby amended by adding the following to the end of the first paragraph thereof:

"(6)      Establishing drainage programs and programs to prevent obstructions to the natural flow of streams, creeks and natural water channels or improving drainage facilities."

Sec. 2.  All laws and clauses of laws in conflict with this act are hereby repealed.

Sec. 3.  This act shall become effective on July 1, 1975, and shall not affect pending litigation.
