HOUSE BILL 35

 

AN ACT AUTHORIZING THE BOARD OF COUNTY COMMISSIONERS AND THE COUNTY ABC BOARD OF CHOWAN COUNTY TO JOINTLY EMPLOY LAW ENFORCEMENT OFFICERS.

 

The General Assembly of North Carolina do enact:

 

Section 1.  In lieu of employing a full-time ABC officer, the Board of Alcoholic Control of Chowan County is hereby authorized to contract with the County Board of Commissioners, upon terms agreeable to both parties, for the employment of a deputy sheriff whose primary duties shall be the enforcement of the ABC laws in Chowan County under the direction and control of the County Board of Alcoholic Control, and who shall perform such other law enforcement duties as may be specified in the agreement under the direction of the Sheriff of Chowan County.

The deputy sheriff herein authorized shall receive the salary specified in the agreement, and the County ABC Board is authorized to contribute to the payment of his salary any portion or all of the amount as authorized by law to expend for law enforcement purposes.

The deputy sheriff so employed shall have the same power and authority conferred upon law enforcement officers by G.S. 18-45.

Sec. 2.  This act shall become effective upon ratification.
