HOUSE BILL 177

 

AN ACT TO AMEND CHAPTER 148 OF THE SESSION LAWS OF 1963 AND CHAPTER 152 OF THE SESSION LAWS OF 1967 RELATING TO THE CHARTER OF THE TOWN OF NAGS HEAD AND TO AMEND SAID CHARTER RELATING TO THE ELECTION OF THE MEMBERS OF THE GOVERNING BODY OF SAID TOWN.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Section 2 of Chapter 148 of the 1963 Session Laws as amended by Section 1 of Chapter 152 of the 1967 Session Laws is hereby amended to read as follows:

"At the regular municipal election on the first Tuesday after the first Monday in May, 1969, there shall be elected five members of the Board of Commissioners of the Town of Nags Head whose terms of office shall begin on the next succeeding Monday following such election, the three candidates receiving the highest vote at said election shall serve for a term of four years and until their successors are duly elected and qualified and the two candidates receiving the next highest votes shall serve for a term of two years and until their successors are duly elected and qualified. Biennially thereafter at the regular biennial municipal elections there shall be elected as many members as there are terms expiring for a term of four years. Any such election shall be held in accordance with the provisions of the General Laws relating to municipal elections provided that all candidates shall file notice of their candidacy with the Town Clerk and Treasurer on or before the 20th day of April preceding any such election and at the time of filing such notice shall pay to the Town Clerk and Treasurer a filing fee of Ten Dollars ($10.00)."

Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3. This Act shall be in full force and effect from and after its ratification.
