AN ACT TO AMEND ARTICLE 10, CHAPTER 163 OF THE GENERAL STATUTES SO AS TO PERMIT ABSENTEE VOTING IN COUNTY AND MUNICIPAL BOND ELECTIONS.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 163-226, as it appears in Section 1 of Chapter 775 of the Session Laws of 1967, is amended as follows:

(a)        By inserting "(a)" immediately before the word "Any" in the first line of said Section.

(b)        By adding the following paragraph at the end of said Section: "(b) Any qualified voter of a county who is qualified to vote by absentee ballot under this Section in a State-wide general election is authorized to vote an absentee ballot in any county bond election in accordance with the provisions of this Article."

Sec. 2.  G.S. 163-136(c), as it appears in Section 1 of Chapter 775 of the Session Laws of 1967, is rewritten to read as follows:

"(c)       Paper Ballots for General Elections and County Bond Elections Where Voting Machines Are Used: In counties in which voting machines are used at some or all voting places, paper ballots shall be printed for purposes of absentee voting in State-wide general elections and in county bond elections under the provisions of Articles 20 and 21."

Sec. 3.  G.S. 163-227, as it appears in Section 1 of Chapter 775 of the Session Laws of 1967, is amended as follows:

(a)        By rewriting the first sentence thereof to read as follows:

"A voter falling in either of the categories defined in § 163-226 may apply for absentee ballots not earlier than forty-five days prior to the State-wide general election or county bond election in which he seeks to vote and not later than 6:00 p.m. on Wednesday before that election."

(b)        By inserting the words "or bond" between the words "general" and "election" wherever they appear in the affidavit and application form prescribed in subsection (a) of said Section.

(c)        By inserting the words "or bond" between the words "general" and "election" wherever they appear in the affidavit and application form prescribed in subsection (b) of said Section.

(d)        By inserting the words "or bond" between the words "general" and "election" wherever they appear in the affidavit and application form prescribed in subsection (c) of said Section.

Sec. 4.  G.S. 163-228, as it appears in Section 1 of Chapter 775 of the Session Laws of 1967, is amended by rewriting the second paragraph thereof to read as follows:

"The Register of Absentee Ballot Applications and Ballots Issued shall constitute a public record and shall be opened to the inspection of any registered voter of the county at any time within thirty days before and thirty days after a State-wide general election, a county bond election, or at any other time when good and sufficient reason may be assigned for its inspection."

Sec. 5.  G.S. 163-229, as it appears in Section 1 of Chapter 775 of the Session Laws of 1967, is amended as follows:

(a)        By rewriting the first sentence of subsection (b) of said Section to read as follows: "In time for use not later than forty-five days before a State-wide general election or county bond election, the county board of elections shall print a sufficient number of envelopes in which persons casting absentee ballots may transmit their marked ballots to the chairman of the county board of elections."

(b)        By deleting the words and punctuation "general election, November" in the affidavit form prescribed in numbered paragraph 2 of subsection (b) of said Section, and by inserting in lieu thereof the following: "general or bond election,".

(c)        By rewriting subsection (c) of said Section to read as follows:

"(c)       Instruction Sheets: In time for use not later than forty-five days before a State-wide general election or county bond election, the county board of elections shall prepare and print a sufficient number of sheets of instructions on how voters are to prepare absentee ballots and return them to the chairman of the county board of elections."

Sec. 6.  G.S. 163-230, as it appears in Section 1 of Chapter 775 of the Session Laws of 1967, is amended by rewriting the first sentence following the title of numbered paragraph one of subsection (b) thereof as follows:

"During the period opening forty-five days before a State-wide general election or county bond election and closing at 6:00 p.m. on Wednesday before the election, the county board of elections shall hold public meetings on Monday and Friday of each week at 10:00 a.m. and it shall also hold public meetings at 10:00 a.m. on both Thursday and Monday immediately preceding election day."

Sec. 7.  All laws and clauses of laws in conflict with this Act are repealed.

Sec. 8.  This Act shall be effective for any election arising on or after September 1, 1967.
