AN ACT TO AUTHORIZE THE BOARD OF EDUCATION OF PAMLICO COUNTY TO CONVEY CERTAIN REAL PROPERTY TO THE TOWN OF ORIENTAL AS A SITE FOR A FIRE STATION, TOWN HALL OR SOME OTHER MUNICIPAL PURPOSE.

 

The General Assembly of North Carolina do enact:

 

Section 1. The Board of Education of Pamlico County is hereby authorized and empowered to convey to the Town of Oriental certain surplus land, not now needed by the said Board of Education, for the purpose of establishing on same by the Town of Oriental a fire station, town hall or for use for some other municipal purpose. The land in question, which is the subject of the conveyance hereby authorized, fronts on the southeast side of Broad Street in the Town of Oriental, a distance of 150 feet, and fronts on the northeast side of Church Street in said town for a distance of 125 feet. Said property is fully described in Deed from T. W. Roberts, et als., trustees of the Missionary Baptist Church at Oriental, to the Board of Education of Pamlico County, dated February 2, 1933, and recorded in the office of the Register of Deeds of Pamlico County in Book 91 at page 44, and said description therein is hereby referred to as a description of the land authorized herein to be conveyed, the same being described as first tract and second tract.

Sec. 2. The Board of Education of Pamlico County is authorized to make such conveyance for a nominal consideration or any other consideration that may be agreed upon between said Board of Education and the Town of Oriental, and the Board of Education of Pamlico County is authorized to execute and deliver deed for such property and to execute any other and further documents that may be necessary to carry out the purposes of this Act. In preparing and executing said deed for said property the Board of Education of Pamlico County shall insert a proper reverter clause or a clause in the nature of a condition subsequent which shall state in substance that the deed shall be effective so long as said land shall be used by said Town of Oriental as the site for a fire station, town hall or some other municipal purpose and that if such condition or defeasible fee is breached or condition of conveyance is broken the title to said property shall revert or again be vested in the Board of Education of Pamlico County.

Sec. 3. All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 4. This Act shall be in full force and effect from and after its ratification.
