AN ACT TO AMEND ARTICLE 4A OF CHAPTER 14 OF THE GENERAL STATUTES RELATING TO SECRET SOCIETIES AND ACTIVITIES.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Article 4A of Chapter 14 of the General Statutes of North Carolina as the same appears in the 1965 Cumulative Supplement, Volume 1B of the General Statutes, is hereby amended by renumbering G.S. 14-12.12 to read: "G.S. 14-12.12(a)."

Sec. 2.  Article 4A of Chapter 14 of the General Statutes of North Carolina as the same appears in the 1965 Cumulative Supplement, Volume 1B of the General Statutes, is hereby amended by adding a new subsection to G.S. 14-12.12(a) and to read as follows:

"(b)      It shall be unlawful for any person or persons to place or cause to be placed on the property of another in this State or on a public street or highway, a burning or naming cross or any manner of exhibit in which a burning or flaming cross real or simulated, is a whole or a part, with the intention of intimidating any person or persons or of preventing them from doing any act which is lawful, or causing them to do any act which is unlawful."

Sec. 3.  Article 4A of Chapter 14 of the General Statutes of North Carolina as the same appears in the 1965 Cumulative Supplement, Volume 1B of the General Statutes is hereby amended by rewriting G.S. 14-12.14 to read as follows:

"§ 14-12.14.  Placing Exhibit While Wearing Mask, Hood, or Other Disguise. It shall be unlawful for any person or persons, while wearing a mask, hood or device whereby the person, face or voice is disguised so as to conceal the identity of the wearer, to place or cause to be placed at or in any place in the State any exhibit of any kind whatsoever, with the intention of intimidating any person or persons, or of preventing them from doing any act which is lawful, or of causing them to do any act which is unlawful."

Sec. 4.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 5.  This Act shall be in full force and effect from and after its ratification.
