AN ACT RELATING TO THE EXTRATERRITORIAL POWERS OF THE TOWNS OF SMITHFIELD AND SELMA.

 

The General Assembly of North Carolina do enact:

 

Section 1. In addition to the one-mile extraterritorial zoning and subdivision control authority granted to the Town of Smithfield by G. S. 160-181.2 and G. S. 160-226, the legislative body of the Town of Smithfield may also exercise such powers in that area lying more than one mile beyond the Town corporate limits and between the corporate limits and the boundary line described in Section 3 of this Act.

Sec. 2. In addition to the one-mile extraterritorial zoning and subdivision control authority granted to the Town of Selma by G. S. 160-181.2 and G. S. 160-226, the legislative body of the Town of Selma may also exercise such powers in that area lying more than one mile beyond the Town corporate limits and between the corporate limits and the boundary line described in Section 3 of this Act.

Sec. 3. The extraterritorial zoning and subdivision control authority granted to the Town of Smithfield and to the Town of Selma, respectively, by G. S. 160-181.2 and G. S. 160-226, and by this Act, shall terminate at the following boundary line:

BEGINNING at a monument in the eastern right of way of Interstate Highway No. I-95, said monument being the southeast corner of a tract of land now owned by Sylvania Electric Products, Inc.; thence the line runs as Sylvania's eastern property line North 26 degrees 36 minutes 30 seconds West 2069.67 feet to a concrete monument in Mrs. A. M. Noble's line; thence as Mrs. Noble's line North 85 degrees 05 minutes 00 second West 440.43 feet to a point in the center of the Atlantic Coast Line Railroad right of way; thence as the center line of said railroad South 62 degrees 41 minutes West 208.35 feet, South 62 degrees 47 minutes 30 seconds West 200 feet, South 64 degrees 33 minutes 00 second West 198.50 feet and South 66 degrees 07 minutes 30 seconds West 51.91 feet to the southeast corner of a tract of land now owned by the Johnston County Produce Co.; thence as their eastern property line North 5 degrees 48 minutes 15 seconds East approximately 900 feet to the center line of U. S. Highway No. 301; thence as the center line of said highway in a southwesterly direction about 580 feet to a point which is 1760 feet East of the center line of N. C. Road No. SR 1923 measured at right angles; thence as a line parallel with SR 1923 on a bearing of North 5 degrees 45 minutes East 2800 feet to the beginning of a 2750 feet radius curve; said point being located 1760 feet East of the center line of N. C. Road No. SR 1923 measured at right angles; thence the line runs as the arc of the 2750 feet radius curve approximately 4260 feet to a point which is located 1760 feet from the center line of SR 1923 measured at right angles; thence the line runs on a bearing of North 84 degrees 32 minutes West approximately 5150 feet to the Neuse River.

Sec. 4. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 5. This Act shall be effective upon its ratification.
