AN ACT TO AMEND G. S. 9-25 SO AS TO PROVIDE STAGGERED TERMS FOR THE GRAND JURY IN BURKE COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. G. S. 9-25, as the same appears in the 1965 Cumulative Supplement to Volume 1B of the General Statutes is hereby amended by adding a new paragraph immediately after subsection (c), to be designated (cc) and to read as follows:

"Burke. At the first term of court for the trial of criminal cases in Burke County after the first day of July, 1967, there shall be chosen a grand jury as now provided by law. The first nine members of the said jury shall serve for a term of one year and the second nine members of the said grand jury shall serve for a term of six months. Thereafter at the first regular criminal term of Superior Court after the first day of January and the first day of July of each year there shall be chosen nine members of the said grand jury to serve for a term of one year. The foreman of the grand jury shall be chosen originally from the members serving a term of one year and thereafter the foreman shall be chosen, from the group which has served as grand jurors for six months, to serve for six months. The foreman shall be chosen by the members of the grand jury."

Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3. This Act shall be in full force and effect from and after its ratification.
