AN ACT TO AMEND CHAPTER 511, SESSION LAWS OF 1951, TO PROVIDE FOR THE ELECTION OF MAYOR AND COMMISSIONERS IN THE TOWN OF WHITE LAKE.

 

The General Assembly of North Carolina do enact:

 

Section 1. Chapter 511, Session Laws of 1951, is hereby amended by rewriting Section 3 thereof to read as follows:

"Sec. 3. The governing body of the Town of White Lake shall consist of a mayor and three commissioners, to be elected by the qualified voters of the municipality. Any person who is a qualified voter under the Constitution of North Carolina shall he eligible to hold office and to vote in all municipal elections. The present members of the board of commissioners and the mayor shall hold office until their successors are elected and qualified as herein provided."

Sec. 2. Section 6 of Chapter 511, Session Laws of 1951, is hereby rewritten to read as follows:

"Sec. 6. At the regular municipal election for 1967, which shall be held on Tuesday after the first Monday in June, 1967, a mayor shall be elected for a term of two years, and there shall be elected three commissioners, as follows: The two candidates receiving the highest number of votes shall be elected for a term of four years, and the candidate receiving the next highest number of votes shall be elected for a term of two years. Beginning in 1969, and biennially thereafter, the regular municipal election shall be held on Tuesday after the first Monday in May, at which time a mayor shall be elected for a term of two years and there shall be elected members of the board of commissioners to take the place of the members whose terms next expire, and the persons so elected shall serve for a term of four years. Any vacancy in the office of mayor or on the board of commissioners shall be filled by the remaining members of the board of commissioners, and the person so appointed shall serve for the unexpired term."

Sec. 3. In the event two or more candidates receive the same number of votes in the 1967 election, the board of canvassers shall determine which candidates are elected for a four-year term and which candidate is elected for a two-year term.

Sec. 4. Section 7, Chapter 511, Session Laws of 1951, is hereby rewritten to read as follows:

"Sec. 7. Persons elected as mayor and members of the board of commissioners, shall qualify and their term of office shall begin on the first Friday following their election. Except as otherwise provided in this Act, all municipal elections in the Town of White Lake shall be held in accordance with the provisions of Article 3, Chapter 160, of the General Statutes of North Carolina."

Sec. 5. Sections 8 and 9 of Chapter 511, Session Laws of 1951, and all laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 6. This Act shall be in full force and effect from and after its ratification.
