AN ACT TO PROVIDE FOR THE NOMINATION AND ELECTION OF MEMBERS TO THE BOARD OF EDUCATION OF GRAHAM COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. The Board of Education of Graham County shall consist of three members to be nominated and elected by the qualified voters of the entire county for terms of four years as herein provided.

Sec. 2. In the primary and general election to be held for county officers in 1970, and quadrennially thereafter, there shall be nominated and elected three members of the Graham County Board of Education.

Sec. 3. The primary and general election provided for herein shall be held and conducted at the same time and under the same laws and regulations pertaining to the nomination and election of county officers as provided in Chapter 163 of the General Statutes except as otherwise provided herein. If the number of candidates of a political party filing notice of candidacy is less or equal to the number of offices to be filled, then such candidates shall be declared the nominees for such political party and no primary election shall be held for such candidates or party, and such nominees' names shall appear on the general election ballot.

Sec. 4. Any vacancy occurring on the Board of Education of Graham County, for any reason, shall for the remainder of the unexpired term be filled by the county executive committee of the political party to which the member causing the vacancy belongs.

Sec. 5. The Graham County Board of Education shall hold its organizational meeting on the first Monday in December, 1970, and quadrennially thereafter, and shall elect a chairman and such other officers as it deems necessary.

Sec. 6. Members of the Board of Education elected in 1970, and thereafter, shall qualify by taking the oath of office on the first Monday in December of the year in which elected, at which time their term of office shall begin.

Sec. 7. The terms of office of the present members of the Graham County Board of Education, all of which expire on the first Monday in April, 1971, shall continue to the first Monday in December, 1970, at which time their terms shall terminate.

Sec. 8. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 9. This Act shall be in full force and effect from and after its ratification.
