AN ACT TO PERMIT GASTON COUNTY AND ALL MUNICIPALITIES IN GASTON COUNTY TO ENTER INTO A COOPERATIVE ASSOCIATION FOR THEIR MUTUAL BENEFIT.

 

The General Assembly of North Carolina do enact:

Section 1. All municipalities in Gaston County, and the County of Gaston, acting through its Board of County Commissioners, and any Sanitary District in Gaston County, are hereby authorized to contract and agree among themselves for the creation, support, maintenance, and operation of one or more voluntary co-operative associations for any purpose or purposes which will tend to facilitate or economize the administration and operation of their respective political subdivisions.

Sec. 2. The political subdivisions, or two or more of them, stated in Section 1 of this Act shall have authority to meet and agree upon a name for any co-operative association formed pursuant to the authority contained in this Act. They shall have authority to adopt a constitution, bylaws, and such rules and regulations for the conduct of business by the association as they shall deem appropriate. Thereafter the various political subdivisions shall have authority to contract and enter into any agreement they deem expedient with the association.

Sec. 3. The voluntary co-operative association herein authorized shall have the same status as a municipality so as to entitle it to all exemptions from State and local taxes as municipalities are entitled to receive, and said association shall be entitled to file for and receive a refund of all State sales taxes and other appropriate taxes paid by it as if the association were a municipality.

Sec. 4. This Act shall be permissive only, and nothing contained herein shall be construed or interpreted as restricting, limiting, or in any way affecting the right of any political subdivision to refuse to enter into the association herein authorized.

Sec. 5. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 6. This Act shall be in full force and effect from and after its ratification.
