HOUSE BILL 379

 

 

AN ACT TO MAKE THE PROVISIONS OF G. S. 128-16 APPLICABLE TO MEMBERS OF THE ONSLOW COUNTY BOARD OF COMMISSIONERS.

 

The General Assembly of North Carolina do enact:

 

Section 1. G. S. 128-16 is hereby amended by inserting after the semicolon in line 2 and immediately before the word "any" the words and punctuation "any member of the Board of County Commissioners;".

Sec. 2. Said Section is further amended by substituting a colon for the period at the end of subdivision (1) and adding the following: "Provided, that failure of a member of the Board of County Commissioners to attend at least one meeting, either special or regular, during a period of two consecutive months shall be construed as wilful and habitual neglect or refusal to perform the duties of the office unless the absence be due to sickness, and provided further that the burden of proving that such absence was due to sickness shall be upon the Commissioner charged under this Section."

Sec. 3. Said Section is further amended by deleting subdivision (6) of G. S. 128-16.

Sec. 4. This Act shall apply only to Onslow County.

Sec. 5. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 6. This Act shall be in full force and effect upon its ratification.
