AN ACT TO PROVIDE FOR THE NONPARTISAN ELECTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF ROXBORO.

 

The General Assembly of North Carolina do enact:

 

Section 1. The regular municipal election in the City of Roxboro shall be nonpartisan and shall be held on Tuesday after the first Monday in May in the odd-numbered years for the purpose of electing a mayor and five members of the city council.

Sec. 2. The mayor and members of the city council shall be elected by all the voters of the city voting at large and the candidate receiving the largest number of votes for mayor and the five candidates receiving the largest numbers of votes for the city council shall be declared elected. The mayor and members of the city council elected as herein provided shall serve for terms of two years or until their successors are elected and qualified.

Sec. 3. Any person desiring to become a candidate for the office of mayor or city councilman shall, at least ten days prior to the date of the election, file with the city clerk a notice of such candidacy in the following form:

"STATE OF NORTH CAROLINA

COUNTY OF PERSON

I, _______________________________________, hereby give notice that I reside in the City of Roxboro, County of Person, State of North Carolina; that I am a candidate for election to the office of mayor, city councilman (strike out inapplicable part), to be voted upon at the municipal election to be held on _____ day of ____________, 19___,

and I hereby request that my name be printed upon the official ballot for such office.

Candidates shall, at the time of filing their notice of candidacy, pay to the city clerk the sum of ten dollars ($10.00), which shall be deposited in the city's general fund.

Sec. 4. All municipal elections in the City of Roxboro shall be conducted in accordance with the laws of North Carolina applicable to municipal elections, except as otherwise provided in this Act.

Sec. 5. Chapter 652 of the Session Laws of 1951 is hereby repealed.

Sec. 6. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 7. This Act shall be in full force and effect from and after January 1, 1967.
