AN ACT TO PROVIDE FOR REVOCATION OF A PERSON'S DRIVER'S LICENSE FOR DRIVING WHILE LICENSE IS SUSPENDED OR REVOKED.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Article 2 of Chapter 20 of the North Carolina General Statutes is hereby amended by adding a new Section to be numbered § 20-28.1 and to read as follows:

"§ 20-28.1.  Driving While License is Suspended or Revoked. (a) Upon receipt of notice of conviction of any motor vehicle moving violation committed while driving a motor vehicle, such offense having been committed while such person's operator's or chauffeur's license was in a state of suspension or revocation, the Department shall revoke the person's license effective on the date set for termination of the suspension or revocation which was in effect at the time of such offense.

(b)        When a license is subject to revocation under this Section, the period of revocation shall be as follows:

(1)        A first such revocation shall be for one year;

(2)        A second such revocation shall be for two years; and

(3)        A third or subsequent such revocation shall be permanent.

(c)        Any person whose license has been permanently revoked under this Section may apply for a new license after three years from the commencement of the permanent revocation. Upon the filing of such application, the Department may, with or without a hearing, issue a new license upon satisfactory proof that the former licensee has been of good behavior for a minimum of three years from the late date of revocation and that his conduct and attitude are such as to entitle him to favorable consideration."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall become effective upon its ratification.
